TERMS & CONDITIONS

1. Acceptance of Service: By using the parking facilities at Park ABZ Ltd (hereinafter 'parkABZ', 'we', 'us', 'our') you agree to be bound by these Terms & Conditions.

2. Booking & Payment: All bookings must be made online 12 hours before arrival at parkABZ; a minimum booking payment for 7 days is required but you may contact us once booked to amend the exit date to a shorter stay but with the full 7 day payment remaining intact; our online parking rate is £3 per day unless a lower promotional rate is on offer; 'per day' means per 24 hours or part thereof; our manual parking rate is £10 per day; our parking charges must be paid in advance; the only acceptable forms of payment are credit/debit cards transacted via our online payment processors; any booking not paid during the online booking process will be automatically cancelled and you will be asked to rebook.

3. Cancellation: Bookings are 100% refunded if written notice of cancellation is given at least 6 hours prior to the scheduled arrival time; bookings cancelled in the 6 hours leading up to the scheduled arrival time will receive a refund of 50%; not arriving by 1 hour after your scheduled arrival time will be deemed a 'no show' with no refund payable; 1 hour after your scheduled arrival time your booking will be cancelled and our site may be closed; if we believe there is a possible error in your booking we will contact you via SMS/email to query it; failure to respond to and verify any query within 24 hours will lead to booking cancellation and a refund of 90%; we reserve the right to cancel your booking without prior notice for any reason provided the cancellation is not on grounds of sex, race, disability, gender, sexual orientation, religion or belief; any such cancellation will receive a refund of 100%; we are not responsible for any indirect, incidental or consequential costs incurred for alternative parking or other arrangements should such a course of action be required; refunds may take up to 10 working days to be processed back to the payment account.

4. Vehicle Drop Off: Vehicles are accepted into our site by appointment only between the hours of 04:00 and 22:00 every weekday; staff will be present at the scheduled arrival time for vehicle handover; arriving prior to your scheduled arrival time may require waiting outside our site until staff arrive; after 22:00 our phones and computers are offline and will not be checked until the later of next morning 04:00 or at the first scheduled vehicle handover of the day or not later than 08:00; we do not accept 'drive in' bookings; staff will be present for vehicle handover at the scheduled arrival time and will remain on site for 1 hour after which if no arrival you will be deemed a 'no show' with automatic cancellation of your booking; this means no refund payable and staff may depart from the site if no other client bookings require handover.

5. Early Collection: Vehicle collection from our site is strictly by appointment only between the hours of 04:00 and 22:00 every weekday; after 22:00 our phones and computers are offline and will not be checked until the later of next morning 04:00 or at the first scheduled vehicle handover of the day or not later than 08:00; staff will be present for vehicle handover at the scheduled collection time and will remain on site for 1 hour; we require 2 hours advance notice for any vehicle being collected before your scheduled collection time; if no such advance notice is given and you arrive at our facility unannounced you may not be able to access our site until handover staff arrive which will be 30 minutes minimum and up to 2 hours maximum from notice; once a reservation has commenced no refund is given for any unused element if a vehicle is uplifted prior to your scheduled collection time.

6. Late Collection:  Any vehicle not uplifted within 2 hours of your scheduled collection time will result in overstay charges being payable; these charges are a fixed £10 per day plus £10 per hour for the hours between 22:00 to 04:00 up to a maximum charge of £70 per day; these charges will begin 2 hours after your scheduled collection time; these charges may be waived by us but goodwill is not a standing policy and is at our sole discretion; it may be possible to claim any overstay charges from your airline if your return flight was delayed or diverted; any vehicle remaining unclaimed 21 days after the scheduled collection time will initiate two written attempts to contact the booking party; if not uplifted 28 days after the scheduled collection time the vehicle will become lien property of parkABZ.

7. Airport Transfers: Passenger transfers to and from the airport are not included in our parking fees; transfer taxis are not organised by or provided by us; the organising of departure and arrival taxis is performed by you by calling our suggested partner or arranging an alternative of your own choice; between 04:00 and 18:00 we suggest calling them at least 15 minutes before pickup; between 18:00 and 04:00 we suggest calling them at least 30 minutes before pick up; taxi availability is outwith our control and may be affected by factors of road traffic, bad weather, time of day, etc; we have partnered with third party entity 'Rainbow City Taxis' on 01224 878787 to offer you the transfer service but you may use any other company at your own discretion; customers are welcome to use us for parking only and make their own transfer arrangements taxi or otherwise; our website taxi cost estimates use fares as set by Aberdeen City Council; should additional taxi, airport or any other charges occur due to customer action or inaction any such fees incurred must be paid by the customer.

8. Vehicle Size: Any vehicle domestic or commercial in excess of 5.5m length requires a double space; additional fees at the online daily parking rate apply if pre-booked; if any vehicle is found to be oversize on arrival at parkABZ the manual daily parking rate of £10 will be payable before accepting said vehicle for parking.

9. Lost Bookings: If you lose or cannot access your booking receipt you may be required to provide us with personal photo identification to confirm your booking and/or identity before the acceptance of or release of any vehicle is authorised by us.

10. Vehicle or Contents Damage: We are not responsible for or liable for any loss or damage to your vehicle or its contents while in our facilities, parked or otherwise; if your vehicle suffers any alleged damage or discrepancy while it is within our facilities for reference purposes you must report it to staff prior to the vehicle exiting our site gate; otherwise no correspondence of any alleged issue will be entered into by us.

11. Road Access: Our site is accessed by a shared private road; should access to our site become impossible due to weather, flooding, accident, roadworks or for any other reason your booking will be cancelled and refunded in full; we are not responsible for any indirect, incidental or consequential costs incurred for alternative parking or other arrangements should such a course of action be required.

12. Security: Our site and its contents are monitored 24/7 by a combination of our staff, CCTV recording, alarm systems and external security patrols albeit not always occurring concurrently; our staff operate by appointment for vehicle handovers and although typically on site daily and often remaining overnight they are not always present 24/7; we will take all reasonable precautions to keep your vehicle and its contents safe; however we are not responsible for any loss or damage to your vehicle or its contents while it is within our facilities, parked or otherwise.

13. Changes to Terms & Conditions: We reserve the right to change these Terms & Conditions at any time without prior notice; your continued use of parkABZ facilities constitutes your acceptance of any changes to these Terms & Conditions.

14. Limitation of Liability: We are not responsible for any indirect, incidental or consequential damages arising from your use of our parking facilities or use of our recommended airport transfer partner or use of any other airport transfer service  arranged independently by you.

15. Third Party Websites: Our website contains links to other external websites; we are not responsible for the operation, content, security or privacy of any third party websites.

16. Governing Law: These terms and conditions are governed by and construed in accordance with the laws of Scotland.

PRIVACY POLICY

(a) Overview: We are committed to protecting the privacy of our website users, in this Privacy Policy we set out how we will deal with your personal details; any information collected and stored will be of the following kind: your visits and use of our website, information provided for the use of registering and/or subscribing to our website service and information provided for the business purposes, quotes, analysis, etc.

(b) Website Visits: We may collect information about your visits to our website such as IP address, location, browser type, referral source, length of visit and number of page views; this information may be used to improve our website usability and for marketing purposes; cookies are used on this website, this enables the web server to identify and track the web browser; we may send a cookie which may be stored by your computer/device; the information we obtain from the cookie could be used to improve the website usability and for marketing purposes; we may also use that information to recognise your computer/device when you visit our website, and to personalise our website for you.

(c) Use of Personal Data: Personal data submitted on this website could be used for the purposes specified in this Privacy Policy or in any relevant parts of the website; in addition to the uses already identified we may use your personal information to improve your browsing experience by personalising the website; we will not provide any personal information to a third party unless you have given your express permission.

(d) Other Disclosures: In addition to disclosures already discussed we may need to disclose the following information: where a country’s legal system requires us to disclose your personal information in connection with any legal proceedings or prospective legal proceedings; in order to establish, exercise or defend our legal rights including providing information to others for the purposes of fraud prevention and reducing credit risk; except as provided in this Privacy Policy we will not provide your information to third parties.

(e) Security of Personal Data: We will take all reasonable precautions to prevent the loss, misuse or alteration of your personal information stored on our servers.

(f) Policy Amendments: We may occasionally update this Privacy Policy by posting a new version on our website; it is in your interest to check this page regularly to ensure you are comfortable with any changes made.

(g) Third Party Websites: Our website contains links to other external websites; we are not responsible for the data policies of any third party websites.

(h) Your Rights: You may instruct us to provide you with any personal information we hold about you; you can by email request us not to use any of your personal details.

These Terms & Conditions together with this Privacy Policy constitute the entire agreement between you and us in relation to your use of our services or website and supersedes all previous agreements in respect of your use of our services or website; by confirming your booking by making payment you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions and Privacy Policy; this page last updated on 1 September 2024.
